This page offers updates and links to filings in the lawsuit challenging DCRA practices that frustrate enforcement of tenant rights under the Rental Housing Conversion and Sale Act, New Capitol Park Plaza Tenants Association, et al. v. District of Columbia, et al., No. 04-CA-7465, in the Superior Court for the District of Columbia. ● Read the Amended Complaint ● Read PLRC’s Public Service Announcement concerning the filing of the lawsuit, which highlights the issues in this case. ● Read the Media Release issued by TENAC, which is one of the Plaintiffs in this case. ● The government filed a Motion to Dismiss on December 10, 2004, and PLRC filed the Plaintiffs’ Opposition to the government’s motion on January 10, 2005. ● On January 19, 2005, the Court issued an Order denying the government’s motion, and providing that the government must file an Answer to the Complaint and that this case will proceed to the discovery phase. ● View the government’s Answer. ● Scheduling Order entered March 4, 2005. ● Legislative update: On February 16, PLRC submitted testimony on a pending D.C. City Council bill that would clarify the Sale Act. After much public participation and expressions of outrage by Councilmembers, the Council passed an Act clarifying the Sale Act and specifying tenant rights to be heard. ● On October 6, 2005, both sides moved for summary judgment: ● On October 26, 2005, the Court held that the lawsuit is now moot in light of the recent legislative clarifications. Among other things, the Court found that the Sale Act amendment "completely and irrevocably eradicated the effects of any of the agency's past violations." Thus, although technically granting the District’s motion, this opinion makes clear that DCRA may not continue the challenged practice and that the previously issued letters are to be given no effect.
